Warning shots are almost always legally a bad idea. If you're able to fire a warning shot it means you are not in immediate danger (at that moment) and using a deadly weapon.

Glad to see things worked out and you weren't harmed though. While it would've been a better ending if you shot the dude, you probably did the right thing as far as you're concerned legally.


he went into the cove I mentioned earlier and we found two bags LOADED with loot. We found out later that broke into my other neighbors apt (whos building faces the street; this is how he got into the building in the first place) and stole their t.v., laptop, xbox, and a bunch of other stuff- got it nicely packed into these bags and was storing it over there while he planned to hit many other apartments- and then load up his van.

Looks like it's going to be a lean Kwanzaa season at this guy's house now.

Even more shocking than the story is the completely braindead responses from all the meatheads. Wow.

did the guy really have a weapon? i know the cops said the gun saved your life, but if this guy came at you with bare hands, don't you feel you would have been able to aptly defend yourself? or did he have a crowbar in his hand?

otherwise, i think it's a good thing you had a gun. but i think racial profiling does not play a part in this situation.

Even if the guy came into his home with just his bare hands and attacked him deadly force would be authorized and warranted. No one breaks into stranger's homes to get into a shoving match like a couple of drunks outside the bar or throw a few punches and wrestle around a little bit then have it broken up. If someone enters your home and presents a menacing appearance, you'd better assume your life is on the line and use the appropriate level of force even if you thank you could "take him". In this case, Varg did the right thing legally as the robber made an attempt to peacefully flee.

The geniuses at Bodybuilding.com who are saying shit like "you should have shot him in the leg" or any other suggestion of non-lethal force are completely wrong. If you intentionally shoot someone in the leg as opposed to the head or chest, a case could be made that you really didn't feel your life was in that much danger if you only wounded the robber.

i'm not saying he was wrong. i was just asking if the person had a weapon. from what it sounds like, the robber didn't really have the intention to attack him. ..but i wasn't in that situation and i'm not passing judgement on how he acted.

yeah, everyone knows --or should know-- that warning shots or maiming shots are more trouble than they're worth.

Long story short, I'm driving back to Iowa tomorrow....to buy another gun.

I've got until the first left on my Iowa permit, and I'm going to take advantage of that. I will go through the proper channels in MA this time and register it- however, that will still take 8-12 fucking weeks. I found out today that's how long it'll take to get my guns back out here- and that's a pretty long time to go without a gun after somebody just broke into your apartment....and possibly wants to come back. ANY handguns out here require you to get a LTC (license to carry) even if you never plan on taking it out and it's sole purpose is home security. I'm not gonna go into what this con$i$t$ of, but I posted updates on the bb.com thread- as well as on sevenstring.org *(under the politices and current events forum).

I told the desk clerks at BPD headquarters today (after being blindsided by their shitty gun laws) that this was my plan. They neither advocated for or against it.
